Terms of Use

Review the terms, responsibilities, and guidelines that apply when renting and operating a vehicle from Nallo’s Rentals.

Rental Rules & Terms of Use

By renting a vehicle from Nallo’s Rentals, the renter agrees to follow the rules and requirements below throughout the entire rental period.

Authorized Driver Only

Only the renter listed and approved on the rental agreement is permitted to drive or have possession of the vehicle.

The vehicle may not be loaned, subleased, rented, or given to another person for any reason, whether payment is involved or not.

No other person is permitted to operate the vehicle unless specifically approved by Nallo’s Rentals in writing.

Legal & Proper Use

The vehicle may only be used for lawful purposes and must be operated in accordance with all traffic laws and regulations.

Vehicles may not be driven on non-paved surfaces, including dirt, gravel, grass, sand, mud, rocks, or other off-road areas.

The renter may not modify, install, remove, attach, or alter anything on the vehicle. This includes lights, power equipment, stickers, passes, RFID devices, radios, antennas, GPS equipment, adhesives, or other accessories.

Company-installed GPS or tracking equipment may not be removed, disconnected, covered, disabled, or tampered with.

Mileage Limit

Unless otherwise stated on your reservation or rental agreement, rentals include 100 miles per rental day.

Additional mileage beyond the included allowance is charged at $0.50 per mile.

Custom & Additional Mileage Packages

The standard 100-mile-per-day limit does not apply when your reservation includes a custom mileage allowance or you have purchased an additional mileage package.

In those cases, the mileage allowance and overage rate specifically provided with your reservation will apply instead of the standard mileage policy.

Fuel

Unless otherwise stated, vehicles are provided with a full tank of fuel and should be returned with the same fuel level.

If the vehicle is returned with less fuel than required, the renter is responsible for the missing fuel. Refueling may be charged at up to double the applicable cost per gallon.

Vehicle Condition & Cleaning

Vehicles must be returned in reasonably clean condition and in substantially the same condition in which they were provided, excluding normal wear from ordinary use.

Cleaning fees may be charged when a vehicle is returned in a condition requiring cleaning beyond what is reasonably expected after a normal rental. This may include excessive trash, spills, stains, excessive dirt or debris, smoke or odor remediation, pet-related messes, or other excessive cleaning needs.

Any applicable cleaning charge will be based on the condition of the vehicle and the cleaning reasonably necessary to restore it.

Damage & Renter Responsibility

The renter is responsible for damage, loss, costs, fees, penalties, fines, taxes, repairs, replacement costs, towing, recovery expenses, administrative costs, and other reasonable expenses caused during or related to the rental, subject to applicable law and insurance coverage.

The renter remains responsible for amounts exceeding any deposit or other funds already collected.

Insurance Required

Valid insurance coverage is required for all rentals.

Unless alternative coverage has been specifically approved for the reservation, the renter must maintain valid full-coverage insurance that extends coverage to rental vehicles. The renter must be a covered/listed driver under the applicable policy.

Proof of insurance may be required before the vehicle is released.

The renter may be financially responsible for vehicle damage or loss that is not covered by an applicable insurance policy.

Security Deposit

If a security deposit is required for your reservation, the amount will be disclosed before or at the time of rental.

Nallo’s Rentals may use an applicable security deposit toward unpaid rental charges, damage, fees, penalties, or other amounts owed under the rental agreement.

A security deposit does not limit the renter’s responsibility. The renter remains responsible for any amount owed beyond the deposit.

Rental Charges & Additional Fees

Rental charges are based on the daily, weekly, monthly, or custom rate agreed upon for the reservation.

The renter is responsible for applicable additional charges associated with the rental, including mileage, fuel, cleaning, damage, towing, recovery, fines, taxes, penalties, and other authorized charges.

Violations & Default

Failure to follow these rules or the signed rental agreement may result in termination of the rental.

When permitted by law and the rental agreement, Nallo’s Rentals may recover the vehicle, collect unpaid balances, seek reimbursement for losses or expenses, and use available collection or legal remedies.

Failure by Nallo’s Rentals to immediately enforce a rule does not waive our right to enforce that rule or another provision later.

Disputes

Any dispute relating to a rental will be handled according to the dispute-resolution provisions contained in the renter’s signed rental agreement and applicable South Dakota law.

Where required by the rental agreement, the parties may be required to attempt mediation and/or arbitration before pursuing certain court remedies.

South Dakota Law

Rentals are governed by applicable South Dakota law.

If any portion of these Terms of Use or the signed rental agreement is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Rental Agreement Controls

These Terms of Use are intended to provide a simple explanation of Nallo’s Rentals’ general rental rules and policies.

Every renter is still subject to the complete rental agreement signed for their specific reservation. If a reservation contains a custom rate, mileage allowance, insurance requirement, fee, restriction, or other term that differs from these general rules, the terms specifically agreed to for that reservation will control.
